Welcome to I Cast Minis. The terms “we”, “us” and “our” refer to I Cast Minis. I Cast Minis operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). I Cast Minis is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced here, describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully before using our Services. By accessing or using any part of the Services, you agree to be bound by these Terms of Service and our Privacy Policy and Refund Policy. If you do not agree to these Terms, you should not use the Services.
Nothing in these Terms affects any rights you may have under applicable consumer law.
SECTION 1 - ACCESS AND ACCOUNT
By using the Services, you confirm that you are at least the age of majority in your country, state or province of residence, or that you are using the Services with the involvement and consent of a parent or guardian where permitted by law.
To use certain parts of the Services, you may be asked to provide information such as your name, email address, billing details, payment details and shipping information. You agree that any information you provide is accurate, current and complete, and that you have the right to provide it.
You are responsible for maintaining the confidentiality of your account credentials and for any activity under your account.
SECTION 2 - OUR PRODUCTS
We make every effort to display our products and services as accurately as possible. However, colours, finishes and appearance may vary depending on your screen, device settings and how the product is viewed in person.
Because our products are individually 3D printed, slight variations in colour, translucency, finish and small support marks may occur. These natural variations are part of the production process and do not necessarily mean an item is faulty.
For custom products made from customer-uploaded STL files or other uploaded content, you are responsible for ensuring that the file you provide is correct, complete and suitable for printing.
We reserve the right to update, change or discontinue products at any time, and to limit quantities on a case-by-case basis.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order. Your order is not accepted until we send confirmation that we have accepted it.
We may refuse, cancel or limit an order where, for example:
- there is an error in pricing or product information
- the uploaded file appears unsuitable, incomplete or unprintable
- we reasonably believe you do not have the necessary rights to the uploaded file
- the order breaches these Terms or any of our policies
- we are unable to fulfil the order for operational reasons
For custom products made from uploaded STL files, you may request cancellation within 2 days of purchase, provided production has not yet begun. After that point, custom orders cannot be cancelled due to change of mind.
For non-custom products, returns and cancellations are governed by our Refund Policy.
You represent that purchases made through the Services are for lawful purposes and not for unlawful resale.
SECTION 4 - PRICES AND BILLING
All prices shown on the Services are subject to change without notice. The price charged will be the price displayed at the time your order is placed and will be confirmed in your order confirmation email.
Unless otherwise stated, prices do not include shipping charges, customs duties, import taxes or similar charges that may apply in the destination country.
You agree to provide current, complete and accurate billing, payment and account information for all purchases, and to update that information promptly if it changes.
SECTION 5 - SHIPPING AND DELIVERY
Delivery times are estimates only and are not guaranteed. Delays can occur due to postal services, couriers, customs processing or circumstances outside our control.
We are responsible for supplying goods in accordance with applicable law. Nothing in these Terms removes any rights you may have if goods are lost, damaged, faulty or not as described.
If your order is delayed, lost in transit, arrives damaged, or arrives with the wrong item, please contact us at hello@icastminis.com.
SECTION 6 - INTELLECTUAL PROPERTY
All content on the Services, including text, graphics, branding, logos, product images, website design and other materials, is owned by or licensed to I Cast Minis and is protected by intellectual property laws.
You may use the Services for personal, non-commercial use only. You must not copy, reproduce, modify, distribute, republish, transmit or exploit any part of the Services without our prior written permission.
If you upload an STL file or other content to us, you confirm that you own it or have all necessary rights and permissions to use it for printing. You grant us a limited licence to use that file only for the purpose of fulfilling your order and related customer support.
SECTION 7 - OPTIONAL TOOLS
We may provide access to third-party tools or services that we do not control. These tools are provided “as is” and “as available” without warranties, representations or endorsements by us.
Your use of any optional third-party tools is entirely at your own risk and subject to the terms of the relevant third-party provider.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain links to third-party websites or services. We are not responsible for the content, policies or practices of any third-party websites.
If you access third-party websites through our Services, you do so at your own risk.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
I Cast Minis is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with I Cast Minis.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and I Cast Minis, including any injury, damage or loss resulting from purchased products or services. You hereby release Shopify and its affiliates from claims arising out of your purchases or transactions with I Cast Minis.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here: https://icastminis.com/policies/refund-policy
Because the Services are hosted by Shopify, Shopify also collects and processes personal information in order to provide and improve the Services. By using the Services, you acknowledge that you have read our Privacy Policy.
SECTION 11 - FEEDBACK AND REVIEWS
If you send us feedback, reviews, suggestions, ideas or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish and display that content for the purpose of operating, improving and promoting our business and Services.
You confirm that any feedback or review you submit is accurate and does not infringe anyone else’s rights or contain unlawful, abusive or misleading material.
We may remove reviews or submissions that we reasonably consider unlawful, misleading, abusive, defamatory, obscene or otherwise inappropriate.

Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery times or availability.
We reserve the right to correct any errors, inaccuracies or omissions, and to update information or cancel orders where necessary.
SECTION 13 - PROHIBITED USES
You may use the Services only for lawful purposes. You must not use the Services:
- for any unlawful, fraudulent or malicious purpose
- to infringe our intellectual property rights or the rights of others
- to transmit harmful code, malware or spam
- to scrape, copy, harvest or extract data from the Services without permission
- to interfere with the operation or security of the Services
- to upload files or content that you do not have the right to use
We may suspend or terminate access to the Services if we reasonably believe you have breached these Terms.

This section applies if you use any automated tool, bot, agent or similar software to access or interact with the Services.
No such tool may access or interact with the Services unless it clearly identifies itself as automated and complies with any technical or operational requirements we impose.
We may restrict, block or limit automated access to the Services at any time.

We may suspend or terminate your access to the Services if you breach these Terms or misuse the Services.
Any obligations or rights that by their nature should continue after termination will continue to apply, including those relating to intellectual property, liability, indemnity and governing law.

We aim to keep the Services accurate, available and secure, but we do not guarantee that the Services will always be uninterrupted, error-free or free from viruses or other harmful components.
To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.
Nothing in these Terms excludes or limits any warranty, condition or right that cannot lawfully be excluded or limited under applicable consumer law.
SECTION 17 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses arising from your use of the Services, including loss of profit, loss of revenue, loss of opportunity or loss of data.
We are not responsible for losses arising from third-party services, third-party websites, shipping delays outside our control, or events outside our reasonable control.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from fraud, death or personal injury caused by negligence, or your statutory consumer rights.
SECTION 18 - INDEMNIFICATION
You agree to indemnify and hold harmless I Cast Minis, Shopify and our service providers from claims, liabilities, damages and expenses arising out of your breach of these Terms, your misuse of the Services, or your infringement of any third-party rights, including where you upload content or files that you do not have the right to use.
SECTION 19 - SEVERABILITY
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be severed and the remainder of the Terms will continue in full force and effect.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
If we do not exercise or enforce any right or provision of these Terms, that does not amount to a waiver of that right or provision.
These Terms, together with any policies linked in them, form the entire agreement between you and us regarding your use of the Services.
SECTION 21 - ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations under these Terms where permitted by law.
SECTION 22 - GOVERNING LAW
These Terms are governed by the laws of England and Wales.
If you are a consumer living outside England and Wales, you may also benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms deprives you of any mandatory consumer protections under applicable law.
